These Terms & Conditions govern your use of the Next Level Footy website and participation in any coaching sessions, clinics, camps, programs or events operated by Next Level Footy ("we", "our", or "us").
By registering yourself or your child for any Next Level Footy program, you acknowledge that you have read, understood and agree to these Terms & Conditions.
1. Eligibility
All registrations for participants under the age of 18 must be completed by a parent or legal guardian. The parent or guardian confirms they have the authority to register the participant and accept these Terms & Conditions on the participant's behalf.
2. Coaching Programs
Next Level Footy provides coaching, development programs, holiday clinics, private coaching and football education for junior Australian Rules Football athletes. Program availability, dates, coaches, venues and schedules may change without notice where reasonably necessary.
3. Participant Responsibilities
Participants are expected to:
- Follow all coach instructions.
- Treat coaches, staff and other participants with respect.
- Display good sportsmanship.
- Wear appropriate footwear and clothing.
- Notify coaches of any injury or medical condition before training.
- Behave in a safe and respectful manner.
Next Level Footy reserves the right to remove any participant whose behaviour is unsafe, disruptive or inappropriate. Refunds will be at our discretion.
4. Parent & Guardian Responsibilities
Parents and guardians agree to:
- Provide accurate registration details.
- Inform us of any medical conditions, allergies or injuries.
- Provide emergency contact information.
- Ensure participants arrive on time and are collected promptly after sessions.
- Notify us if their child is unable to attend.
5. Medical Consent
The parent or guardian confirms that the participant is medically fit to participate in football training. If an injury or illness occurs during a session, the parent or guardian authorises Next Level Footy staff to administer basic first aid and, where necessary, seek medical treatment or emergency assistance. Any medical expenses remain the responsibility of the participant or their parent/guardian.
6. Assumption of Risk
Australian Rules Football is a physical sport involving inherent risks, including but not limited to:
- Falls
- Collisions
- Sprains and strains
- Fractures
- Concussion
- Other sporting injuries
By registering, parents and guardians acknowledge these risks and accept that participation is voluntary.
7. Release of Liability
To the maximum extent permitted by Australian law, Next Level Footy, its directors, coaches, employees and contractors are not liable for any injury, illness, loss or damage arising from participation in our programs, except where liability cannot legally be excluded. Nothing in these Terms excludes any rights available under the Australian Consumer Law.
8. Payments
Payment must be made before participation unless otherwise agreed. Prices are displayed in Australian Dollars (AUD).
9. Cancellations & Refunds
If Next Level Footy cancels a session due to weather, venue availability or unforeseen circumstances, we may:
- Reschedule the session;
- Offer a credit; or
- Provide a refund where appropriate.
Refunds for participant cancellations are at the discretion of Next Level Footy unless required by law.
10. Weather Policy
Training may continue during light rain where it is safe to do so.
Sessions may be postponed or cancelled in cases of:
- Lightning
- Extreme heat
- Flooding
- Dangerous weather conditions
- Unsafe playing surfaces
11. Photography & Video Consent
Next Level Footy regularly photographs and records coaching sessions, clinics and events. By registering for any Next Level Footy program, the parent or legal guardian grants permission for photographs, video recordings and other media containing the participant's image or likeness to be used by Next Level Footy for legitimate business purposes, including:
- Our website
- Social media platforms
- Printed marketing materials
- Digital advertising
- Promotional videos
- Email marketing
- Media publications
- Future promotional campaigns
- Educational content
- Other marketing and promotional activities relating to Next Level Footy
No compensation will be payable for the use of these images or recordings.
If a parent or guardian does not wish their child to appear in photographs or video recordings, they must provide written notice to Next Level Footy before the participant attends their first training session or event.
Upon receiving written notice, Next Level Footy will make reasonable efforts to ensure the participant is not intentionally photographed or featured in promotional content. However, incidental appearance in group photographs or event footage may not always be avoidable.
12. Intellectual Property
All coaching materials, videos, logos, branding, graphics, website content and training resources remain the property of Next Level Footy. They may not be copied, reproduced or distributed without written permission.
13. Website Use
Users agree not to:
- Misuse the website.
- Attempt to gain unauthorised access.
- Introduce malicious software.
- Copy website content without permission.
14. Privacy
Personal information is handled in accordance with the Next Level Footy Privacy Policy.
15. Changes to Programs
Next Level Footy reserves the right to change:
- Coaches
- Venues
- Session times
- Program content
- Dates
Where reasonably necessary.
16. Changes to These Terms
These Terms & Conditions may be updated from time to time. The latest version will always be published on our website.
17. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Victoria.
